Terms of Service
Last updated: 10 August 2026
1. Who you are contracting with
These Terms of Service govern your use of the Lex Aurum platform (the "Service"). The Service is provided by Lex Aurum ("Lex Aurum", "we", "us"), and by using the Service you are entering into an agreement with Lex Aurum. If you use the Service on behalf of a firm, chambers, institution, or other organisation, you confirm that you have authority to bind that organisation to these terms. If you use it as an individual, you confirm that you are of legal age to contract.
2. Acceptance
By creating an account, subscribing to a plan, or continuing to use the Service, you agree to be bound by these terms. If you do not agree, you must stop using the Service.
3. The Service
Lex Aurum is a software-as-a-service product. It provides AI-assisted research, drafting, document analysis, a template library, judgment intelligence, and matter management tools oriented to South African law. Access is granted under a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected, for your own professional or study purposes. The Service is fully digital: there are no physical goods and no human-delivered service component.
We do not provide legal or other regulated professional services. Lex Aurum is not a law firm, is not an attorney, advocate, or legal practitioner, and is not a regulated professional services provider. We do not give legal advice, consultations, opinions, or representation, we do not accept instructions on any matter, and no attorney–client or other professional relationship is created by using the Service. You purchase access to software tools only; all professional judgement, verification, and client work remains yours.
4. Accounts and credentials
You must provide accurate registration information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity carried out under your account. Plan seats and daily usage allowances are personal to the account (or, for firm plans, to the named organisation) and may not be shared beyond the licensed users.
5. Acceptable use and misuse
You must not:
- use the Service for any unlawful purpose, or in breach of any court rule, professional rule of conduct, or applicable law;
- use the Service for fraud, spam, harassment, or misrepresentation;
- infringe the intellectual property or privacy rights of any person, including uploading material you have no right to upload;
- interfere with the security or integrity of the Service, including introducing malware, probing or scanning systems, circumventing usage limits or access controls, or scraping the platform;
- reverse engineer, decompile, resell, sublicense, or redistribute the Service or its outputs as a competing product.
6. Artificial intelligence: use and limitations
The Service uses generative AI models to produce research summaries, drafts, digests, and document analysis. You acknowledge and agree that:
- Outputs may be inaccurate, incomplete, or out of date. Case citations, statutory references, and summaries must be independently verified against the primary source before being relied on, filed, or advised upon.
- Outputs are not legal advice and do not create an attorney–client relationship. The Service is a professional research and drafting aid, and is not a substitute for the independent professional judgement of an admitted legal practitioner.
- You are responsible for your prompts and for how you use outputs, including compliance with your professional duties, client confidentiality obligations, and any court practice directives on the use of AI.
- You must have the rights to any content you input, including client documents, and must have any consent required to process personal information contained in them.
You must not use the Service to generate illegal content, deepfakes, hate speech, malware, or material designed to deceive a court or tribunal, and you must not attempt to jailbreak, bypass, or manipulate the safety controls of the underlying models.
We may moderate content: we may filter, refuse, restrict, or remove inputs or outputs, and suspend accounts, where we reasonably believe this clause has been breached. Rights holders may report alleged infringement to info@lexaurum.co.za; we will investigate, remove infringing material where appropriate, and terminate the accounts of repeat infringers.
7. Your content
You retain ownership of the documents, matter data, and prompts you submit ("User Content"). You grant us a limited licence to host, process, and transmit User Content solely to operate and provide the Service to you. As between you and us, outputs generated from your prompts are yours to use, subject to these terms and to any third-party rights in the underlying source material.
8. Our intellectual property
Lex Aurum retains all ownership of the Service and its intellectual property, including the software, models and prompts we develop, template library, interface, documentation, and branding. Nothing in these terms transfers any of that to you.
9. Service levels
We aim to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. The Service may be unavailable for maintenance, upgrades, or reasons beyond our control, and third-party AI providers may change or throttle their services.
10. Payments, subscriptions and tax
Subscriptions are sold on the plans and prices published on our pricing page and renew automatically for successive monthly periods until cancelled. Daily AI usage allowances apply per plan on a fair-use basis.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, invoicing, tax (including VAT), cancellation, and refund mechanics are therefore governed by the Paddle Buyer Terms. See also our Refund Policy.
11. Suspension and termination
We may suspend or terminate your access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may cancel at any time from the Billing page in your account, which opens the Paddle customer portal, or by contacting us; your access continues until the end of the paid period. On termination you may request a copy of your matter data within 30 days by emailing info@lexaurum.co.za, after which it may be deleted or anonymised.
12. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability arising out of or in connection with the Service is limited to the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, loss of data, or loss of goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.
You indemnify us against claims arising from your User Content, your unlawful use of the Service, or your breach of these terms.
13. General
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms and will post the revised version here with a new "last updated" date.
